Every agency in New South Wales works under the Property and Stock Agents Act 2002 and the 2024 Supervision Guidelines, and the person answerable for its trust records, its policy sign-offs and its staff licences is the Licensee in Charge, personally.

Inspections are unannounced. NSW Fair Trading ran more than 2,200 of them in 2024–25, issued $1.58 million in fines and suspended 55 licences, and its public register lists fines, suspensions and cancellations by name.

The Guidelines make the licensee personally verify every assistant agent’s logbook, and the registers — complaints, risks, keys, material facts, beneficial interests, referrals and privacy — are among the records an inspector asks to see.

Most systems file that work under the transaction. The audit trail an inspector wants is per property.
